Introduction

We understand that you are aware of and care about your own personal privacy interests, and we take that seriously. This Privacy Notice describes FunnelStory’s policies and practices regarding its collection and use of your personal data, and sets forth your privacy rights. We recognize that information privacy is an ongoing responsibility, and so we will from time to time update this Privacy Notice as we undertake new personal data practices or adopt new privacy policies.

How we collect and use (process) your personal information

FunnelStory collects personal information about its website visitors and customers. With a few exceptions, this information is generally limited to:

  • work phone number

We use this information to provide prospects and customers with services.

We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of our services.

From time to time, FunnelStory receives personal information about individuals from third parties. Typically, information collected from third parties will include further details on your employer or industry. We may also collect your personal data from a third party website (e.g. LinkedIn).

Use of the FunnelStory Website

As is true of most other websites, FunnelStory’s website collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of FunnelStory’s website, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our website, analyze trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences.

FunnelStory has a legitimate interest in understanding how members, customers and potential customers use its website. This assists FunnelStory with providing more relevant products and services, with communicating value to our sponsors and corporate members, and with providing appropriate staffing to meet member and customer needs.

FunnelStory may use cookies and other technologies for performance, tracking, analytics and personalization purposes. We may share non-identifiable / aggregated extracts of such information with our partners for our legitimate business purposes.

Data Privacy Framework (DPF) Compliance

FunnelStory, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. FunnelStory, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. FunnelStory, Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.   • Inquiries and Complaints: In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, FunnelStory, Inc. commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact FunnelStory, Inc. at: [email protected].
  • Independent Recourse Mechanism: In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, FunnelStory, Inc. commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. This service is provided at no cost to you.
  • Binding Arbitration: You may have the option to select binding arbitration for the resolution of your complaint under certain circumstances, provided you have taken certain preliminary steps. To find out more, please see Annex I of the DPF Principles.

When and how we share information with third parties

We do not reveal your personal data to non-FunnelStory persons or businesses for their independent use unless: (1) you request or authorize it; (2) the information is provided to comply with the law (for example, compelled by law enforcement to comply with a search warrant, subpoena, or court order), enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; (3) the information is provided to our agents, vendors or service providers who perform functions on our behalf; (4) to address emergencies or acts of God; or (5) to address disputes, claims, or to persons demonstrating legal authority to act on your behalf.

  • Onward Transfers to Third Parties: FunnelStory may disclose personal information to third-party Subprocessors and service providers for the purposes of providing our services. We remain liable for the processing of personal data by these third parties acting as our agents under the DPF Principles. We will ensure that any third party to which we disclose personal information provides the same level of protection as required by the DPF Principles.
  • Lawful Requests by Public Authorities: FunnelStory is required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Transferring personal data to the U.S.

FunnelStory has its headquarters in the United States. Information we collect about you will be processed in the United States. By using FunnelStory’s services, you acknowledge that your personal information will be processed in the United States. FunnelStory endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with FunnelStory and the practices described in this Privacy Statement.

Data Subject rights

The European Union’s General Data Protection Regulation (GDPR) and other countries’ privacy laws provide certain rights for data subjects. This Privacy Notice is intended to provide you with information about what personal data FunnelStory collects about you and how it is used.

  • Right of Access: You have the right to access your personal data to confirm that FunnelStory is processing it and to request information about the processing.
  • Other Rights: You may also have the right to correct (rectify) the record of your personal data, request that FunnelStory erase that data or cease processing it (subject to certain exceptions), and request that FunnelStory cease using your data for direct marketing purposes.
  • Choices and Means to Limit Use and Disclosure: We offer individuals the choice to opt-out of having their personal information disclosed to a third party (who is not an agent) or used for a purpose that is materially different from the purpose for which it was originally collected or subsequently authorized by the individual. Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, FunnelStory will provide you with a date when the information will be provided. If for some reason access is denied, FunnelStory will provide an explanation as to why access has been denied.

Security of your information

FunnelStory is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

Data storage and retention

Your personal data is stored by FunnelStory on its servers, and on the servers of the cloud-based database management services FunnelStory engages, located in the United States. FunnelStory retains service data for the duration of the customer’s business relationship with FunnelStory and for a period of time thereafter, to analyze the data for FunnelStory’s own operations, and for historical and archiving purposes associated with FunnelStory’s services.
